# 📧 “Potential ADA violation”

[I emailed you a week or so ago](https://gijustice.com/blog/nytimes-gaslights), along with others CCed here because [Dave Philipps](https://gijustice.com/blog/tag/NYTimes+veteran+reporter), who is employed by the NYTimes to report on a community of which he is not a member, accused me of having a mental illness. Let me be clear: **A diagnosis without a professional relationship or credentials is an accusation.** Besides directly contradicting your own [standards for ethical journalism](https://www.nytimes.com/editorial-standards/ethical-journalism.html?ref=gijustice.com), it might also be a violation of the ADA;

Philipps hid his *own* moral failure behind a "mental illness" for which he had no evidence. His claim was a fabrication.

Philipps had no grounds to even *speculate* on the content of my medical records. I CCed the NYTimes mental health reporter in my last correspondence because she should know how inappropriate his actions were. Since nobody replied to point me toward an *internal* accountability process, I will take my concerns public.

Next month I will be testifying before the Oregon Legislature on anti-military bias, a topic Philipps has consistently refused to report on. At that hearing, I will include in my testimony [a petition to unsubscribe from the NYTimes](https://chng.it/wQ9hYCGPw2?ref=gijustice.com). By gaslighting members of a community he profits off of, David Philipps is fueling military suicide by ignoring credible news tips so that he can continue feeling better about 'helping (us) out.' You have a choice;

Sanction David Philipps, or replace him.

Don't do it for me, though, [Philipps said it himself](https://gijustice.com/blog/nytimes-gaslights), "If there was a different person in this job they might pick different stories." If the NY Times wants to be a credible source of news, you cannot "seek the truth" while paying reporters who obscure it.
