On January 27, 2025, I spoke with Oregon Legislative Counsel about how to move the MCRA draft from a former Representative's docket to a current lawmaker to introduce.

Logan M Isaac: Hi, my name is Logan Isaac. I, um, I've been trying to find out what's been going on with LC 2650. Uh, it was introdu- or it was submitted by James Hieb, and there's a couple of different hands in the pot trying to like...

LAC Counsel: Yes. Hi, this is, uh, [redacted]. Sorry.

Logan M Isaac: Oh, sorry. I just-I thought I was leaving a voicemail I just picked up. Yeah. Sorry. Um, I'm trying to figure out if it's possible to move a legislative concept, um, through a different office than that submitted it.

LAC Counsel: Um, so once an LC has been introduced, it becomes a bill, and that, that's the bill.

Um, [00:01:00] so if there's... Yeah, so if an LC number, LC 123, has been, uh, filed with the clerk of the peoples-

Logan M Isaac: Well, let me, let me-

LAC Counsel: You know ...

Logan M Isaac: backtrack. I may have misspoke. Yeah. The LC was submitted... It, it was submitted, it became an LC in September by James Hieb. He wasn't reelected. He didn't tell me. Okay. And so it got...

It fell into, um, purgatory, and there's... I'm trying to find out who, if anybody, and whether it has to be a representative or a senator if it matters, can take that LC and introduce it themselves. Uh, I don't think it's been introduced yet.

LAC Counsel: All right. Yeah. If, if an LC number has not been introduced, uh, any legislature can take it and file it in their respective chamber.

Logan M Isaac: Okay. Do... Can you tell me if you've heard from, uh, Senator Thatcher, Senator [00:02:00] Gelser, or Representative Boshart Davis? I believe that I gave them this, uh, the same information I gave you, and I know... I'm suppo- I'm... Thatcher asked me to testify tomorrow, so I'm under a bit of a deadline, but I don't want to ask you to do something you're not allowed to do.

I'm just trying to understand the system.

LAC Counsel: Uh, what's the LC number, do you... again?

Logan M Isaac: 2650 or fi- 6... 2650 or 2560. I- I'm very sorry. I wrote it down, but I get the two numbers mixed up. But it was submitted by Hieb, and it's, uh, pertains to military civil rights.

LAC Counsel: Okay, two five six zero

Uh, so, um[00:03:00]

I'm not finding that it's been filed introduced

Logan M Isaac: It might have been 2560.

LAC Counsel: Yeah. Yeah. Um-

Logan M Isaac: Or 2650.

LAC Counsel: So what I can, uh, uh, I don't... I'm not finding a bill that's been filed on the public record that is, um-

Logan M Isaac: No, it'd still be as, as an LC.

LAC Counsel: Yeah.

Logan M Isaac: Oh, okay.

LAC Counsel: Um, yeah. So, uh, I mean, so basically like I, uh, you know, as an, a our office is not allowed to share sort of information.

Um, and I know that you were a stakeholder in providing input. Uh, and so I do see that your consultation on 2560 drafting it, um, it has not been filed with [00:04:00] the speakers.

Logan M Isaac: Okay.

LAC Counsel: Um, and so that's, yeah.

Logan M Isaac: Is if, if I can get one of my, uh, elected representatives, S- uh, Senator Gelser or Representative Boshart, are they able or allowed to use that LC or take that LC and introduce it themselves?

LAC Counsel: They, yes, but they might not have access to it. And, and what I mean by that is that LC2560 is Representative Hieb's

kind of private LC.

Logan M Isaac: Oh, okay.

LAC Counsel: Um, yeah. And so unless he hands it off, says, "Yeah, you can use this," uh, and if he does that, then they, sure, they, they can file if they want to. Um, they can [00:05:00] also, your other representatives can still request bills. So, um, uh, I mean, if, if they wanna request a bill that is in the top of those, you know, the same kind of legislative concept, they're free to,

Logan M Isaac: uh- It would just be a little bit later in the session, right?

'Cause it wouldn't be at the t- front of the line.

LAC Counsel: Uh, sorry. Yeah. In terms of process, so, uh, legislators have until February 21st to file, uh, an l- legislative concept with their chambers.

Logan M Isaac: Okay.

LAC Counsel: Um, so Okay.

Logan M Isaac: So they can start from scratch, and they have until the 21st of February?

LAC Counsel: Yes. Yeah.

Logan M Isaac: Okay. Okay. All right, that, uh, that's helpful.

I'll, I'll speak with them then.

LAC Counsel: Okay. And, and th- [00:06:00] they're not gonna have access to, to Rep Hieb's LC. Uh, if you have a copy of it, you can show it to them. Okay. You know, that's, it's out, it's out of the public domain at that point. Um, so-

Logan M Isaac: Okay ...

LAC Counsel: what, what they can't do, they can't... So let's say Representative, uh, or Senator Gelser, sh- she can't come to me and say, "Draft the same bills that you did for Rep Hieb," 'cause all the work that I did personally for Rep Hieb is confidential.

Logan M Isaac: Oh.

LAC Counsel: And I can't share that with other legislatures.

Logan M Isaac: Okay.

LAC Counsel: But if, if you as a public member have a copy of the bill, of the LC, and if you take it to them, it's sort of in that public sphere at that point.

Okay. If that makes sense.

Logan M Isaac: Yeah, yeah. I think I get it. Okay. All right. That's helpful. Yeah. I appreciate it.
