Ms. \[Melissa\] Rawlinson,

Thank you for speaking with me today at 1315\. This is a settlement communication under FRE 408 and ORS 40.190, as you confirmed on the call. I'm writing to confirm what we discussed. 

1. **Representation.** You confirmed that Miller Nash currently represents OSU only, and that this could extend to individual OSU employees if necessary. If that changes, please tell me and identify who is added.
2. **Monetary terms.** You asked for a figure. As I said on the call, my present opening position is a range of $500,000 to $2,000,000\. It reflects my current assessment, it is not exhaustive. I referenced Garza v. City of Salem (D. Or. 2023) as one data point, not as a prediction of outcome.
3. **Non-monetary terms.** The non-monetary terms in my October 1 email are an equal part of any resolution, not secondary to the monetary terms: the acknowledgment letter, confirmation that Exclusion 2025-082137 is cleared, the revised exclusion procedure, and release of the records described there. My right to those records under the Public Records Law does not depend on resolution of the other terms.
4. **Authority and timing.** Please let me know who at OSU has authority over the monetary and non-monetary terms, and when I can expect a response. As we agreed on the call, I will reach out to you if I don't hear from you by Thursday evening, October 22, 2026.
5. **Preservation.** Please confirm that OSU is preserving all records relating to my April 1, 2026 arrest and Exclusion 2025-082137, including body-worn camera and dashcam video, RMS and LEDS entries and audit logs, threat-assessment and DPS files, and related communications.
