This is a settlement communication under FRE 408 and ORS 40.190.

On our call and in your later email, you indicated you hoped to have something for me by Thursday, October 22. I understand that you have qualified that, and I appreciate your being candid about it. I'm writing to explain why dates matter so much to me, and to ask for your help in establishing a timeline I can rely on.

My PTSD, which is service-connected, was aggravated by the April 1 arrest and the exclusion behind it. I am also awaiting an ADHD screening and evaluation through the VA. Together, these make open-ended waiting harder for me than it would be for others, and I tend to fixate on dates and closure. If it would be useful to you, I can provide documentation of these points in a form we agree on in advance.

I have also been less active in seeking legal assistance since OSU appeared to be taking responsibility, and I relied on that. Each additional delay in a response compounds the harm the exclusion and arrest have already caused, which I contend were unlawful.

I forwarded you this Cub Scout incident only so you understand the continuing practical effect of the unresolved exclusion and the waiting, and I expect OSU to take responsibility for that as well.

I want to resolve this as quickly and painlessly as possible, for reasons that go beyond my own injuries. The events of April 1 have also set back my work, including my small business in the same community, and my advocacy for a protected class that lacks adequate federal protection. That advocacy includes my pending federal action against the Department of Justice in Eugene, No. 6:26-cv-00832-MTK, which I mention only as a matter of public record.

I need to be given only dates that you personally can vouch for. Past dates communicated on OSU's behalf have not held specify, the October 23 response date you articulated on our phone call, and I don't hold that against you, but I can't plan around dates that may move.

To that end, could you please tell me:

  1. Who at OSU must approve a response, and whether they have been given a date to act by.
  2. The earliest date by which you can commit to giving me a substantive response, and whether you will stand behind that date.
  3. How you propose we set up a timeline I can count on, for example a short written schedule with interim dates, and a commitment to tell me promptly and in writing, with the reason, if any date will slip.

I would appreciate a reply by 1500 on Thursday, October 29.
