π call with Kareem Walcott, OSU
Kareem Walcott, OSU: [00:00:00] I, uh, received the voice message that you left yesterday evening.
Logan M Isaac: No, this is probably the best time I'll have all day, even if it's a little bit truncated, so.
Kareem Walcott, OSU: Okay. So you said you had some questions that I'm happy to have-
Logan M Isaac: Oh, yeah
Kareem Walcott, OSU: my best answer.
Logan M Isaac: Yeah, so the response to the subpoena claimed that there was no responsive documents for something like two through five. Is it- Mm-hmm ... your understanding that Oregon State Police received an email from Oregon State University about a potential threat and did not respond?
Do you want me to ask the question again? I don't
Kareem Walcott, OSU: understand. Yeah.
Logan M Isaac: Do you have the paperwork in front of you or do I need to brief you on what it said?
Kareem Walcott, OSU: No, I, I have the subpoena. I also have the scope limitation that you put in the subpoena as well
Logan M Isaac: So
Kareem Walcott, OSU: I, [00:01:00] I'm happy to, uh, you know, if you wanna try to rephrase the question, I'm happy to, uh, discuss that with you as well.
Logan M Isaac: Uh, rephrase the question. You said there's no responsive documents to most of the items in that subpoena. That is telling me- Right ... and it would tell the court, and it would tell, is telling the court, that the fact is, supported by that evidence, that the state police received an email about a th- potential threat and said nothing in return.
Are you putting that on the state police?
Kareem Walcott, OSU: What I'm saying is we have no additional communications related to your, um, restrictions that were placed
Logan M Isaac: In DPS or in the threat assessment? Was
Kareem Walcott, OSU: related to the, uh, search, uh, at the Capitol.
Logan M Isaac: Yeah. So, I get really tired of [00:02:00] the semantic games. I know- Yeah ... that the subpoena also said you searched DPS.
Did you search the threat assessment team?
Kareem Walcott, OSU: So like I said as well, the scope limitation that you put in the, that, um, piece basically said that you were not seeking any records related to your May sixth, twenty twenty-five exclusion, nor were you seeking records related to your April one, twenty twenty-six. Any records that we would have from the threat assessment team are not in response to the, um, your capital restrictions.
It would only be responsive to any of those exclusions or incidents that occur. So given the scope limitation that you put in there, OSU doesn't have any responsive records, um, from prior two through four, [00:03:00] I believe, or two through five.
Logan M Isaac: All right.
Kareem Walcott, OSU: Yeah, two through five.
Logan M Isaac: Yeah, I think, I think we're just leaning on a misunderstanding.
Who is the- Okay. Um, who is the custodian of records for the Oregon State University emails?
Kareem Walcott, OSU: So we don't have a central... So
Logan M Isaac: as a university here- Okay, let me rephrase it. Let me rephrase it. I, I, I don't have much time. Centralized, yeah. Discovery closes in two days, so it's this or I ask for an extension to depose Yon.
Who searched the email records?
Kareem Walcott, OSU: That would've occurred through, um, DPS themselves.
Logan M Isaac: So you trusted DPS to search their own records, is that correct?
Kareem Walcott, OSU: Why would I not?
Logan M Isaac: All right. Um, what terms were searched? Only the ones stated in the subpoena?
Kareem Walcott, OSU: [00:04:00] Correct
Logan M Isaac: Were any texts or personal devices checked?
Kareem Walcott, OSU: Yes.
Logan M Isaac: And no responsive documents were discovered in personal devices, is that correct?
Kareem Walcott, OSU: That is correct.
Logan M Isaac: Was anything withheld under objection?
Kareem Walcott, OSU: Like I said, the only thing that we No. So I'm operating under the s- the scope limitation that you put on there
Logan M Isaac: You've already said that
Kareem Walcott, OSU: And if there was any... I'm sorry?
Logan M Isaac: I know. I already heard that. I'm asking was anything withheld under objection?
Kareem Walcott, OSU: I will rely upon my response, sir.
Logan M Isaac: Okay. Uh, what, who is the threat assessment team's home unit? [00:05:00] Who is, who is ultimately responsible for that? Is that the provost, the dean of students? Is it DPS? There's a lot of different units that were listed. Who would be the person directly responsible or primarily responsible for the threat assessment team?
Kareem Walcott, OSU: So what I can share is if you go to the threat assessment team, that's through our public safety, and it also identifies who makes up that. I'm happy to share the link
Logan M Isaac: as well- I've already read
Kareem Walcott, OSU: it ... in a, uh... I'm sorry?
Logan M Isaac: But listing a bunch of things and then saying, "Well, we only searched one of them," seems, seems like you're trying to cut corners.
What-- Who is the-- Who's responsible for the threat assessment? What unit or person res- is primarily responsible for it? It does not list it on the website. I've already read it.
Kareem Walcott, OSU: Well, like I said, it, it's on-- it's housed on our, our public safety [00:06:00] officer's, uh, office website. So that's the primary source. Now, the-- as far as who is, uh, point, if you will, for the threat assessment team, but understand, as stated on the website, there are different units that are supported or a part of that team, which are, which are indicated on that website that sounds like you already took a look at.
Logan M Isaac: And you don't have an answer as to where the buck stops other than DPS?
Kareem Walcott, OSU: I, I'm, I'm s- I'm really not following your, your train of questions or-
Logan M Isaac: All right, so let me tell you how it looks ...
Kareem Walcott, OSU: And I, I apologize, but I'm... There's not really a buck stops somewhere other than this is all university records, so again, I don't, I don't hear or understand the...
what exactly you're trying to get at.
Logan M Isaac: Yeah, you're [00:07:00] coming about it- You've already said- ... from a different perspective, and that's because you weren't the victim of a conspiracy to deprive me of my constitutional rights. So let me tell you how it looks. OSU, and specifically Willie Elfering, and potentially Laura Skousen, and possibly William Henkel, all knew about my protected advocacy well in advance.
And on May 6th, another veteran at the Veterans Center at a public university invited me into his office, told me to close the door, and we had a heated conversation that then was used as factual pretext to ban me from 26,000 acres of Oregon public property. When I appealed that, Yohn, without me knowing, had already sought out supporting evidence to deny me my constitutional rights after he had heard that someone else had banned me from the Capitol.
So that, that denial [00:08:00] of the appeal from Yohn begins to look highly suspicious that he was looking to ban me from public property without factual prete- without factual predicate. Yohn sent an email to Oregon State Police specifically citing the threat assessment team, and your account, based on the evidence you've provided and/or withheld, suggests that the Oregon State Police received an email from another public agency about a threat and ignored it, or I don't have all the records.
One way or another, something is wrong. Either you did not s- complete a sufficient search, or the Oregon State Police doesn't give a shit about threats. Those are the two basic options. So if OSU is deferring to OSP, I... then I need to depose them, and I've got two days to do it, or I need to file a motion for extension.
If I file that motion for extension, one of the first documents I'm gonna be [00:09:00] sending you is a deposition or a subpoena to depose James Yohn, because either James Yohn is the bad actor, or OSU is trying to protect Yohn from his bad acting. Those are my going, running theories right now. So that's why I asked you- Okay
is it, is it, is your evidence sufficient, or does it support a, another theory, right? Are you telling me that you trust DPS, who falsely arrested me and engaged in malicious prosecution, are you telling me that it was Jan or Beaton or Willie or some mix of them? Or are you protecting what that might possib- that that might possibly be the case?
Or if it's not, it's just a comedy of errors and the Oregon State Police, a state agency, ignored a threat email. Something's not adding up, [00:10:00] and it's either because you haven't given me all the documentation and we're playing semantic games or, and it's very possible, Oregon State Police is, is in, in dereliction of their duty.
I can't tell which one it is, but it's one of them. It can't be both. Or actually, it could be both.
So
Kareem Walcott, OSU: what I'm telling you is that based off your request, we provided all the responsive records that we have.
Logan M Isaac: So is that an I don't know? Because this is also a request
Kareem Walcott, OSU: What is the request?
Logan M Isaac: Confirm that OSP never responded to Jan, or if they did, where did that correspondence disappear to?
Kareem Walcott, OSU: So we don't have any [00:11:00] records related to any additional correspondence.
Logan M Isaac: And you can say that confidently- What I know- ... before a federal court?
Kareem Walcott, OSU: Yes. Yep.
Logan M Isaac: Okay.
Kareem Walcott, OSU: Happy to do it.
Logan M Isaac: Okay. But the, but part of that rests on, did I hear you correctly that DPS searched their own records?
Kareem Walcott, OSU: That's right
Logan M Isaac: Who at DPS searched those records?
Kareem Walcott, OSU: That I can't actually share with you.
Logan M Isaac: Why not?
Kareem Walcott, OSU: Now, if you are asking custodian of the records, 'cause that's a certifying privilege. But if you want a custodian-
Logan M Isaac: No, it
Kareem Walcott, OSU: is not ... of the record, send that over and we can have that conversation about whether or not, um, who in that office can fill that out.
Logan M Isaac: If you're trying to pr- protect someone from incrimination, they can plead [00:12:00] the fifth.
But it's not privileged records to ask a foundational fact. You have until 1700 today to tell me who searched those records so I can depose them, or I'm going to file a motion to extend and start deposing people at OSU, 1700. That's 5:00 PM.
Kareem Walcott, OSU: We'll see. We'll see your motions and let us know.
Logan M Isaac: What do you mean you'll see my motion?
Kareem Walcott, OSU: You'll- you've already told us what your plan of action is, and I've already shared with you the best way that we can have that, um, provide you with any information related to who actually, uh, uh, is the custodian that can verify the records that were actually sent. Right. So if you wanna send over a certificate-
Logan M Isaac: Hey,
Kareem Walcott, OSU: I- -of, uh,
Logan M Isaac: uh, the custodian for- Yeah, I can do that.
And I'm going to remind you that Michael McShane- Yeah, that
Kareem Walcott, OSU: would be helpful for us to be able to, uh, get that answer for you ...
Logan M Isaac: Michael McShane has already said, the judge in federal court has already said he will intervene for withholding [00:13:00] evidence. Asking for the custodian is not privileged information.
So I'll get the paperwork. Okay. McShane's gonna be pissed off because we're going to extend because you- Okay ... you're claiming privilege for s- for a foundational
Kareem Walcott, OSU: fact. The third party did a solicitation, so I, I, you know, I, I'm only providing the information that we have in our records. Now, if there's- Right
additional information that you can easily get from OSP, by all means- I can't find out who the custodian is from OSP ... get that information. I, I'm, I'm, I'm responding as a, as from Oregon State's piece of whether or not we have any responsive records pursuant to that subpoena, and that's what we've provided.
Logan M Isaac: You're withholding my ability... You're withholding evidence to prove who the custodian is. You're claiming privilege for a foundational fact. You're, you're saying the only-
Kareem Walcott, OSU: I ask you just to send over a certificate for the, the custodian of record piece. And if you can send that over, we'd be happy to, to fill that out for you.
Logan M Isaac: Yeah. And if you're gonna make work [00:14:00] for me, it's completely fair that I make work for you. I'm not a lawyer. Like, I am just a citizen who's sick and tired of having to deal with entitled institutions who are making- Mm-hmm ... who are making life easier for people violating our Constitution. It is not privileged to ask who the custodian of records is.
The fact that you're withholding that information increases the likelihood of bad faith. Jan is either a party to the conspiracy or OSU is entirely. It's a third party right now, but I may need to request leave to amend the, the pleadings because OSU seems to be violating the local rules and federal rules of civil procedure.
I know it is not protected who the custodian is. If you can't answer that, "Yes, I, Kareem Walcott, searched it," you have an obligation under the law to tell me who the custodian is. You're refusing to do that while claiming privilege. I think that is factually, or I'm sorry, legally unfounded. So we're going to have to create more [00:15:00] paperwork just because you're trying to protect someone.
That is what I'm saying. Oh, uh, you're a public agency. You're on duty. It's nine twenty-five. This phone call is being recorded because you're a public official and because I, I have to use AI and I have to transcribe and record and blah, blah, blah. So seventeen hundred, do you want me to wait or should I just get to work on it at my next break?
Kareem Walcott, OSU: Next time, please inform me if you're gonna retor- record our calls, 'cause I don't consent to any of our calls being recorded in the
Logan M Isaac: future. I don't give a shit what OSU consents to.
Kareem Walcott, OSU: And I will wait for whatever you need to send. I think that ends our call today. So I hope you have a good rest of your day, sir.
Logan M Isaac: I hope you don't, 'cause I'm at least honest.
