Mufid Elfgeeh, a naturalized citizen and pizza shop owner in New York City, purchased a firearm and silencer with plans to murder a regular customer serving in the Army. He was arrested on May 31, 2014, and although Section 4712 of the Hate Crimes Prevention Act made it a hate crime to target victims “on account of their military service,” Elfgeeh was never charged with a hate crime under 18 U.S.C. § 1389.
