🔀 Isaac v. Oregon
On April 8 and 9, 2025, the Oregon Department of Justice filed a motion to be named sole defendant in my Section 1983 small claim against Reneé Perry, Shelly Boshart Davis, and Brett Hanes. The motions were signed by Senior Assistant Attorney General Rebecca D. Maile under the authority of Oregon Attorney General Dan Rayfield.
The motion to was approved by the Judge for the case against Reneé Perry, making the State of Oregon the sole named defendant rather than Perry. Below are the motions submitted followed by transcripts.




APPEARANCE OF DEFENDANT AND REQUEST FOR HEARING
Defendant [Reneé Perry, Shelly Boshart Davis, Brett Hanes] denies the claim of the plaintiff [Logan Isaac] and requests a hearing.
REQUEST FOR CONSENT TO APPEAR ON BEHALF OF DEFENDANT
Defendant moves under ORS 46.415(4), through the Oregon Attorney General, to allow an appearance by the Oregon Attorney General's office on behalf of defendant in this case.
This request is two-fold. First, defendant requests that the "Appearance of Defendant and Request for Hearing" filed in this case be allowed to stand as defendant's answer to the small claims complaints. Second, defendant requests that a non-lawyer representative of the Oregon Department of Justice be allowed to appear at the hearing.
The Oregon Attorney General's office normally represents the defendant in small claims actions brought against the State. The practice of this office is to have a non-lawyer employee of the Department of Justice assist in collecting and presenting evidence in small claims hearings and related proceedings. That is what our office also requests in this case.
MOTION TO SUBSTITUTE THE STATE OF OREGON AS THE SOLE DEFENDANT
The State of Oregon, under ORS 30.265(I), requests an Order from the Court substituting the State of Oregon as sole defendant for currently named defendant Renee Perry.
