📧 “Re: Referred” from TSW
Dear Mr. Isaac:
I’ve looked further into this matter. There’s no question that you participated in the JBIC event, and that the insights that you shared were moving and meaningful. Participation in an event, however, doesn’t necessarily convey copyrights, and copyrights are distinct from publicity/privacy rights. At this time, for purposes of amicably resolving this matter, I think it makes sense that we agree to disagree on the legal merits of your assertions.
TSW considered your specific requests, and responds as follows:
A copy of the reversion letter is attached. (For its part, The Simple Way months ago removed all JBIC products from both its online and physical store.)
Mr. Raymond, a HarperCollins Vice President and Publisher, notified you, in his e-mail dated July 27, 2020, that HarperCollins had reverted the rights in JBIC to TSW (see #1 above), that HarperCollins would, within 30 days, remove the materials that you identified, and that any remaining copies in HarperCollins possession would be destroyed. We trust that HarperCollins will do as it says, understanding, particularly during these days of the pandemic, that sometimes things take longer to implement than expected. If TSW learns that HarperCollins is infringing TSW’s rights, TSW will reach out to HarperCollins to address such issue. (HarperCollins is not an agent of TSW, nor am I aware of any support for the claim that you’re a “contract partner” of TSW, but, as noted above, we can at least agree to disagree on these legal points, in the interest of amicably resolving this matter.)
Mr. Claiborne sent Mr. Gundry an e-mail dated August 3, 2020. It’s our understanding that you were bcc:ed on that e-mail. If you didn’t receive a copy of the e-mail, let me know, and I’ll send you one.
