📧 “PETITION” from Benton DA
Your petition to appeal a public record request denial by Oregon State University has been received.
Our office’s standard protocol is to allow both parties the opportunity to submit documents in support of their positions. It appears you have already provided documentation and legal argument in support of your position. However, if you have any supplemental information you would like me to consider, please provide that to me, copying the OSU entities/individuals I have copied above (or as otherwise requested by OSU in response to my email here), by no later than May 4, 2026.
I would then invite OSU to provide any documentation or legal argument in support of their denial of records and responsive to documents or argument that has been or will be provided by Mr. Isaac, by May 15, 2026, and copying Mr. Isaac with any such response.
Once such requested documents/argument have been received, I will seek to render a decision by May 20, 2026.
I would seek clarification, from OSU, as soon as possible, in regard to what records have been agreed to be disclosed. My assumption is that all records responsive to Mr. Isaac’s request, both the original and supplementary, were included in OSU’s April 27, 2026 estimated cost of production and are agreeable by OSU to be provided, excluding only Body Cam Footage.
